The Role of AHCP Legal Services

The AHCP Legal Services protect the Association’s Not For Profit and Charitable Intents Status, ensure regulatory compliance, and manage risk. They secure the AHCP's foundation by overseeing governance, employment matters, commercial contracts, and data protection, ultimately allowing the AHCP to safely pursue its core mission and safeguard its reputation. 

Exploring the Role of AHCP Legal Services

The specific roles and responsibilities of legal services at the AHCP generally include:

 

1. Governance and Compliance

Governing Documents: Ensuring the AHCP's constitution, articles of association, or governing documents are up-to-date and reflect its core purpose. 

Trustee Duties: Advising trustees or directors on their legal duties, conflicts of interest, and best practices in corporate governance. 

Regulatory Liaison: Managing communications and filings with regulatory bodies—such as the Charity Commission or relevant tax authorities—and ensuring statutory compliance. 

 

2. Operational and Commercial Support

Contract Negotiation: Reviewing and drafting commercial contracts, service delivery agreements, and vendor partnerships to protect the organization's interests. 

Employment and HR: Advising on employment contracts, workplace policies, safeguarding concerns, and handling disputes or tribunals. 

Property and Assets: Managing commercial leases, asset transfers, and property disputes, which are often the most significant physical assets an NFP holds.

Copyright Matters: Managing and protecting all of the AHCP’s copyright matters/data/properties, by making sure that false people do not impersonate the AHCP, or falsely suing its data, images, information and properties for dubious means and false financial gains.

 

3. Fundraising and Financial Strategy

Fundraising Compliance: Advising on campaigns, legacy gifts, and commercial partnerships to ensure they adhere to fundraising regulations and consumer protection laws.

Intellectual Property (IP): Protecting the organisation's brand, trademarks, and copyrights against unauthorised use.

Tax and Structuring: Structuring corporate subsidiaries, handling tax exemptions, and navigating mergers or strategic restructurings. 

 

4. Risk and Crisis Management

Data Protection: Navigating GDPR and other data protection rules to ensure sensitive donor and beneficiary information is handled lawfully. 

Dispute Resolution: Mediating internal conflicts and representing the organisation in litigation or regulatory investigations when necessary.
